Minutes – November 2021

99-21. Public comment – The PC agreed to extend the public discussion time to 30mins to discuss the recent flooding and incorporate this with DCC and SHDC updates.
A member of the public thanked the PC, Devon County Council (DCC), South West Water (SWW) and the Road Warden for acting swiftly to help resolve the issues created by the flooding in Brook Street and raised concerns around this occurring again in the future due to increasing climate change and heavy rainfalls and what steps could now be taken to prevent this happening again.
Cllr R Foss advised he had attended a site visit with several Cllrs and Cllr J Brazil on the 29th October to understand the situation which had been caused by blocked buddle holes, overgrown hedges, trees dropping leaves onto the road, blocked drains and a substantial amount of rainfall. As the village is in a basin any water runs to the lowest point. He also had driven around the village on 30/11/21 after a weekend of rain to check no further flooding had occurred. Cllr Foss had been in liaison with the landowner who was in attendance at the meeting and who had agreed to help where possible in terms of cutting back hedges, clearing buddle holes and working with the tenant farmer re correct field management.
Cllr J Brazil advised local solutions would be to put in hedges via the Tree Warden scheme, digging out the drains and re-instate the buddle holes. In order to get the village back to a condition where if could then be maintained locally, he acknowledged that some intervention would be needed and budget to support this work.
Cllr R Foss advised that SHDC/DCC did not have any monies to help and advised the PC to precept the costs to employ local contactors and a full time lengthsman to then manage the village roads, as had been employed in the past. Cllr Foss advised that Bio-diversity management did not apply to highways and roadsides needed to be kept clear of weeds and foliage. Also, to work with local landowners to ensure they were letting road water into their fields, putting bales around field perimeters to catch silt, for local parishioners to kick the leaves of drains when walking past to keep clear. The landowner raised that not all fields had hedges and this was an issue.
A parishioner raised the need to slow down the rainwater on the roads. Cllr Foss advised the buddle holes would do this by diverting water off the roads into the fields.
A parishioner raised that field management was a contributing factor; wider grass margins needed to be left around the edge of fields and the fields plough in the correct direction so as not to direct water downhill. Cllr Foss advised it was the responsibility of the landowner to manage their fields correctly. The landowner agreed to put in wider margins in fields.
Cllr Foss advised that studies had been undertaken on the matter of soil erosion and that sheep fields suffered the worst erosion as sheep feet compacted the soil down so that the land could not absorb water. He highlighted the positive benefits of no-till / zero-till field cultivation on flood reduction. Fields were now not ploughed as much and seeds planted by pricking the soil. Cllr Foss summarised that to prevent further flooding, action needed to be taken to manage both water run-off and leaves (Re-instate and manage buddle holes, ensure wide field margins, correct ploughing directions, keep drains cleaned and free of leaves, and that there was a need for the parish to work together to manage the situation ongoing.) In Frogmore a farmer had installed a new lake to catch water in. Cllr Foss stated that DCC needed to take some responsibility as Highways had installed the flood drains on the roads concerned.
The Chair reported that the PC already paid for annual drain cleaning and highways sweeping plus a road warden 2 days a month to manage the drains and roads. The Chair asked if there was a climate change budget that could be provided to the parish to support further work. Cllr Foss stated that the SHDC Climate Change budget was to support bio-diversity and not highways and that all costs needed to go on the precept and that the PC needed to provide this service and charge the parish for this as, without this action, the PC was not providing necessary services to the parish.
Cllr Brazil advised he had met with the head of DCC Highways after the site visit on the 19th October and many parishes were struggling to cope with the lack of central maintenance caused by the 60% cut in Government funding and that funding was focussed in Education, Social Care and Potholes. Cllr Brazil would ask if the current cost of DCC drainage maintenance and any DCC funded lengthsman work could be provided to the parish so that they could better target and fund this work using their parish lengthsman.
The Chair extended a formal thank you to everyone involved in dealing with the flood and to all residents who had helped and worked with DCC, SWW and the road warden. Cllr R Foss also praised this action and encouraged self-help by all parishioners. A parishioner stated that there was a lot of self-help in action in the village but this still wasn’t enough support.
Cllr Foss re-stated that it would then be necessary to precept for a full-time lengthsman. Cllr Brazil agreed and would see if DCC could set up a lengthsman scheme similar to the DCC P3 pathways funding scheme. The Road Warden stated that the drains were keep clear and the issue was that the grills were too heavy to lift to clear out the silt.
The Chair stated that the blocked drains were caused by the loose road chippings left by the contractor on the roads after the current resurfacing works and run of silt from newbuild sites in the village.
Cllr Abbey raised that it was hard to find the drains and buddle holes in the overgrown vegetation down the site of the roads and under the silt.
The Chair asked if DCC can cut the edges to the roads back in so that the drains and buddle can be exposed and maintained from a good starting position.
Cllr Foss advised there was an issue of removing this soil due to potential TB contamination and that it needed to go back into the hedges.
Cllr Brazil agreed that the village needed some help in ploughing out the roadsides so that it was not an overwhelming task for local maintenance and would speak to DCC.
The Chair stated that the village must have some central help so that it could be pro-active going forward.
The Road Warden raised concerns about lack of tarmac being in place if the road edges were ploughed out. Cllr Foss stated this the wrong focus and that the buddle holes must be exposed and cleared.
The Chair asked Cllr Brazil if DCC Highways could come out to both clear the roadside edges and then advise what solutions needed to be put in place e.g., extending the concrete roadside guttering. The Chair also asked the landowner and Cllr Foss how the PC could communicate with landowners and that really it was for DCC and SHDC to lead on pressing landowners to manage their land correctly not the PC’s role. The Chair also asked the landowner if all hedges could be cut back by the 29th November as on the 30th November the village and roads were being professionally cleaned. This was agreed.
Cllr Brazil advised that the Environmental Agency looked after sea defences and not roads, DCC is the lead inland Flood Defence agency. Cllr Brazil reported that other parishes which had flooded had spent money on developing a flood scheme working with a consultant and one farmer had dug a bund to capture water and new drains had been installed under the roads to take rain water away. The landowner agreed to put in margins around the field and raised the issue of a blocked drainage pipe going into White Close.
Cllr J Brazil advised would follow up with John Gait at DCC. Clerk to put the landowner in touch with the Tree Warden to discuss hedge solutions. The Road Warden and Cllr Mitchelmore to distribute sandbags to resident of Brook Street and nearby effected properties on 1-11-21.
The flood discussions ended at 19.50pm and all parishioners and the Road Warden left the meeting.
100-21. Devon and Cornwall Police Councillor Advocate Scheme Update.
- Cllr Murphy reported that he was attending the annual Police Cllr Advocate Conference on the 8th November at St Mellion.
101-21. County & District Councillor reports
Devon County Council (DCC) report from Cllr J Brazil:
a. Cllr J Brazil reported there was a local community meeting being held at Stokely to discuss parishes concerns of the road breaching with MP Anthony Mangnall. Cllr Abbey and Cllr Wollacott reported they were attending to represent the PC. Cllr Brazil advised that the main hurdles to be overcome to secure resources to protect the road are that the area needs to be redesignated as not an SSSI site, Local Authorities do not have the funding and there is no Adaptation Manager in place to help lead this. The Chair raised that it was not acceptable that this position had not yet been filled. Cllr Brazil stated that if the road goes then parking will be required at both ends and there was a need to speak to local landowners. Cllr Foss also stated that both himself and Cllr Brazil were equally frustrated and were pushing hard to gather action on this matter. The Chair and Vice Chair stated that the SLP meetings needed to be outside of normal working hours so that they can attend. Cllr Murphy stated that in the past this was the case. Cllr Brazil agreed to ask the SLP if the meeting times could be changed.
b. Newton Abbot pilot scheme for a 20mph speed limit in residential areas was going ahead, but any county-wide roll-out would not be approved without adequate data.
c. Road Closure: The A379 through Chillington will be closed from 7-18th February 2022 for flood works/ repairs from Coleridge Lane to Fairfield Way. On the 15th November pre-emptive works are taking place. Access to the doctors will still be possible via the neighbouring housing estate.
d. Traffic Survey: The Chair reported the traffic survey was now complete and asked Cllr Brazil who to contact to forward the data to engage a formal SCARF survey. Cllr Brazil advised to send the data to Lisa Edmunds in Highways with a formal request, and should this be declined then Cllr Brazil and Cllr Foss can consider supporting with localities grants as it was likely that the PC would not receive DCC funding. Funds are also available from Devon and Cornwall Police to support local speed reduction initiatives. Cllr Foss advised that Churchstow had 2 new traffic signs showing green and red warning speeds and this was a good example to consider. Clerk to forward data to Highways / investigate Police funding grants.

106.21 Matters for discussion
a).Proposed Maintenance Plan Agreement re Beach War Memorial. The PC discussed the matter and agreed to support the proposal financially but for Strete PC to take the lead re maintenance and fund management as originally agreed. Clerk to update co-ordinator.
b). CSG Committee terms of reference amendment. The PC agreed to amend the terms to 2 Cllrs in attendance with the option of the meeting to be chaired by a CSG Volunteer and this to be decided at each annual CSG meeting. Clerk to amend the Terms. Chair to update the CSG Committee.
c). Carr Lane – The quote was approved to trim back the overhanging trees on the corner of Carr Lane as advised by DCC Highways, following the cutting guidance provided by the Tree Wardens. Clerk to brief the Road Warden.
d). Road Warden Brief next 2 months. It was agreed that Wood Lane needed attention to remove the overhanging foliage on the wall of the FSC, plus all leaves to be swept onto the road on the 29th November ahead of the 30th November commercial road sweep and the Buddle Holes to be cleared following the hedge cutting. Clerk to brief Road Warden.
e). Village speed survey: Refer item 101.21 (d) above. Cllr Murphy to include the results in the December edition of the Slapton Lines.
f).Parish Neighbourhood Plan – The PC voted unanimously for the CSG to progress leading the development of a Neighbourhood Plan in consultation with the PC. Cllr Sullock advised had a copy of the original Parish Plan for reference. Chair to update CSG Committee next meeting.
g).Land for sale in parish. No action, Land Sold.
h). 2022 Draft Parish Budget Plan. Due to the extended time of the meeting, the PC agreed to hold a working party meeting at 7pm on 7/11/21 and carry to the next Meeting.

109.21. Chair’s report
- An interview is being held on 3/11 for one of the 2 Cllr Vacancies. Vacancy advertising still being progressed and Cllr Wollacott is developing website content to help attract candidates.
- The full dog bins at Brandis Park and Marsh Lane have been reported by the Chair and Cllr Mitchelmore. The Chair asked if Cllr Staines could monitor all the black bins, dog bins and the bottle bank on a Tuesday and Thursday weekly and report any required collections via the SHDC Report-It website and forward the receipt to the PC to keep on top of the matter for parishioners.

- Cllr Staines – Advised a parishioner had reported an abandoned vehicle against the wall on Sands Road. The PC advised this belonged to a parishioner.
